Of the September term of the Adams Circuit Court in the year of our Lord one thousand eight-hundred and thirty five

The Grand Jurors chosen selected sworn in and for the said county of Adams in the name and by the authority of the people of the state of Illinois unpon their oaths present that John Craig late of the county of Adams and state of Illinois not having the fear of God before his eyes but being moved and seduced by the instigation of the Devil on the twelfth day of April in the year of our Lord one thousand eight hundred and thirty five with force and arms at and within the County of Adams aforesaid in and upon one Joshua Pierce in the peace of God and the people of the state of Illinois then and there being unlawfully felouiously wilfully and of his malace aforethought did make an assault. And that the said John Craig with a certain large five shovel made of iron of the value of one dollar which he the said John Craig then and there had and held in both his hands him the said Joshua Pierce in and upon the right side of the head just above right ear did beat and strike and that the said John Craig did then and there given unto him the said Joshua Pierce by such striking at him with this shoval aforsaid one mortal bruise in and upon the said right side of the head Just above the right ear of him the said Joshua Pierce of the length of two inches and the scull depressed and fractured depth of half an inch of which said mortal bruise the said Joshua Pierce on and from the said twelfth day of April in the year of our Lord one thousand eight hundred and thirty five until the twentieth day of April in the year of our Lord one thousand eight hundred and thirty five until the twentieth day of April in this year last aforsaid at this in the County of Adams aforsaid did languish and languishing did live on which said twentieth day of April in the year of our Lord one thousand eight hundred and thirty five he the said Joshua Pierce at the County of Adams aforsaid of the mortal bruise aforsaid died. And so the Jurors aforsaid upon their oath aforsaid do say that the said John Craig him the said Joshua Pierce in the manner and by the means aforsaid unlawfully feloneously wilfully and of his malice afore though did kill and murder contrary to the form of the statute in such case made and provided and against the peace and degrity of the same people of the state of Illinois.

And the Grand Jurors chosen selected and sworn as aforsaid in the name and by the authority of the people of the State of Illinois upon their oaths further present that John Craig late of Adams County on the twelfth day of April in the year of our Lord one thousand eight hundred and thirty five with form and arms at and within the County of Adams in the state of Illinois in and upon one Joshua Pierce in the peace of God and the people of the state of Illinois then and there being unlawfully feloniously wilfully and voluntarioly did make an assault and that the said John Craig with a certain made of iron shovel of the value of one dollar which he the said John Craig had then and there had and held in both his hands him the said Joshua Pierce in and upon the right side of the head above the right ear of him the said Joshua Pierce then and there unlawfully feloniously willfully and voluntarily did hit and strike and that the said John Craig then and there give unto him the said Joshua Pierce by such striking at him with shovel aforsaid one contusion the said Joshua Pierce on and from the said twelvth day of April in the year of our Lord one thousand eight hundred and thirty five at the County of Adams aforsaid of the mortal fracture and contusion aforsaid died. And so the Jurors aforsaid upon their oaths aforsaid do say that the said John Craig him the said Joshua Pierce in the manner and by the means aforsaid voluntarily wilfully and lawfully and feloniously did kill and slay contrary to the form of the statute in such cases made and provided and against the peace and dignity of the same people of the state of Illinois.
